The Tirana Court has found the arrest in flagrante delicto of 17 people detained during the protest to be unlawful, ordering their release and the non-imposition of security measures. For 5 others, the arrest was deemed lawful and the measure of obligation to report to the Judicial Police was imposed. In total, the Tirana Court has released from prison 22 protesters who took part in gatherings that were accompanied by tensions.
The Tirana Court of First Instance of General Jurisdiction examined the Prosecution’s requests concerning the arrested persons, who are suspected of criminal offences related to organizing and taking part in unlawful assemblies and demonstrations, resisting public order police officers and, in some cases, destroying property. According to the decisions presented, for A. R., A. B., D. L., G. B., A. L., Y. I., Rr. Ç. and A. S., the court found the arrest in flagrante delicto to be unlawful, rejected the requests for imposing security measures, and ordered their immediate release, unless they are held for another legal reason.
The court made the same decision for L. M., as well as for several others included in a separate decision, among them A. B., F. L., Dh. H., B. T. and K. P. For these persons, the non-imposition of security measures and immediate release were ordered, unless there are other legal grounds for their detention.
Meanwhile, for T. T. and F. M., the arrest in flagrante delicto was deemed lawful, but the court imposed the personal security measure “Obligation to report to the Judicial Police”. They must report to the Prosecutor’s Office attached to the Tirana Court on the first and third Monday of each month, at 10:00.
In another decision, the same security measure was also imposed on citizens M. M., L. S. and E. G., who must report on the third Monday of each month, at 10:00, to the Judicial Police Officer of the relevant section of the Tirana Prosecutor’s Office.
For citizen D. D., the court found the arrest to be unlawful, but also imposed the obligation to report to the Judicial Police. As for citizen E. B., suspected of resisting a public order police officer, the arrest was deemed unlawful and no security measure was imposed.
